They have been historically called Real Estate Investment Trusts (REITs).  Hedge funds have been around for at least 40 years. Their success has ebbed and waned because they are susceptible to interest rate swings.  As interest rates go higher, the hedge funds value goes down to give the newest investor a higher income. - [You Made How Much on the Rehab?](https://davedinkel.com/how-much-does-rehab-cost/): I don’t relate these actual occurrences except to help readers understand how things can sometimes go horribly wrong in real estate investing. In this case a very experienced and successful Student purchased a property for $185,000.  He decided not to wholesale it for a quick $35,000 profit. Instead he believed he could get $330,000 if he rehabbed the property.  I changed the prices to protect the innocent (buyer and Student). The Student was correct and he sold the property for $330,000 nine months later.  However, let’s look at what went terribly wrong. - [Huge Price Drop in Miami Gardens Properties?](https://davedinkel.com/violations-for-non-permitted-work/): Suddenly, like turning on a lightbulb, the city of Miami Gardens has instructed their enforcement officers to start issuing violations for non-permitted work when they do their re-inspections. Some rehabbers have worked this community for years and done many rehabs.  They have been shocked in their recent re-inspections to find that what was always overlooked in the past is now an issue that stops the sale of their beautiful rehab. Conventional lenders will generally not finance otherwise financeable properties if open permits exist at the time of closing - [Who Owns The House In The Back Yard?](https://davedinkel.com/title-survey/): The Student closed and got title insurance when he closed.  Later on though the County said the structure in the rear was illegal and had to be demolished.  What happened was he tried to get an electrical permit to upgrade the electric and install a water meter.  This case is still out about what will happen but the County has remained steadfast that the structure cannot be permitted and must be torn down.  He has a couple of options including suing the County and making a title policy claim.  He would have had a good chance at getting his money back from the title company if he had gotten a title survey done before the closing. - [That’s a Great Deal at $30K Profit or Is It?](https://davedinkel.com/real-estate-investing-profit/): In this example, the Student having no money in the transaction, isn’t a bad real estate investing profit.  However, the deal killer here was the end-buyer needing conventional financing and the uncertainty of actually getting timely financing. - [Agent uses PDF Editor to change State Approved Real Estate Contracts](https://davedinkel.com/state-approved-real-estate-contracts/): A rage that has been going on for some time is the purchase of Homeowners Association (HOA) liens at the foreclosure auction.  Up until the last five years HOAs seldom used the foreclosure process to collect back fees and assessments.   Because most units continued to pay these expenses the HOAs managed to make ends meet and simply sat out the consequences. - [Attorney Simply Strikes Out Parts of Vital Real Estate Contract Clauses](https://davedinkel.com/real-estate-contract-clauses/): Just when you think you have seen it all something new comes up.  A Student called and asked me to look at a contract he had received back from a seller.  The contract had a large number of changes that were either struck out or written over.  While I don’t give legal advice I do have an opinion on real estate contract clauses and changes sellers or buyers make to an existing contract. - [As Is Real Estate Contract Does Not Mean As Is](https://davedinkel.com/as-is-real-estate-contract/): It is a very common misconception that when a seller uses a real estate contract designated “As Is, Where Is” that the buyer must accept whatever problem the property has at closing.  The reality is that probably 90% of contracts that are written as "As Is" contracts do not close unless something has been changed or repaired before closing. - [Are Quitclaim Deeds Simply Rip-offs?](https://davedinkel.com/quitclaim-deeds/): A growing trend in real estate sales is for sellers to transfer title by using Quitclaim Deeds (a.k.a. Who knew? - [Assignment of Real Estate Contract](https://davedinkel.com/assignment-of-real-estate-contract/): How to use an Assignment of Real Estate Contract on something you don't own.  The question that constantly comes up in wholesaling real estate is “How can you sell something you don’t own?” You can’t sell something you don’t own UNLESS you have an equitable interest in the property. As investors this equitable interest takes the form of a signed contract from the seller.
